Hebei's Motorcars and Motorcycles Subsidy Program for Rural Areas and the Measures of Fiscal Subsidies on Hebei's Motorcars and Motorcycles Subsidy have gained the approval of the government. Hebei's Motorcars and Motorcycles Subsidy Program for Rural Areas

In order to attach great importance to the making fiscal subsidies for farmers' buying motorcars and motorcycles, this implementation is made on the basis of our actual situation and Motorcars and Motorcycles Subsidy Program for Rural Areas£¨Finance and Construction [2009] No. 104£© by Department of Finance, Development and Reform Committee, Industry and Information Technology Department, Provincial Public Security, Provincial Administration for Industry and Commerce, Provincial Bureau of Quality and Technical Supervision.

I. This policy aims at improve the purchasing power of farmers, speeding up the upgrading of rural consumption, elevating the producing and living conditions of farmers, promoting the renewal and upgrading of motorcars and motorcycles, realizing the industrial structure optimization and upgrading of motorcars and motorcycles, and meeting the need of coordinating the inside and outside.

II. Content of the policy

( I.) Subsidies and Targets

From March 1, 2009 to December 31, farmers who report the three-wheeled vehicles (referring to the original three-wheeled agricultural vehicles, the same below) or low-speed vehicles (referring to the original four-wheel agricultural vehicles, the same below) as worthless and buy light trucks (hereinafter referred to exchange light trucks), will enjoy double subsidies of buying new ones and abandoning the old ones. Each household is only allowed to buy one unit. The owner of the end-of-life vehicle and the new one should be the same person. Farmers of our province can also enjoy the subsidies if they buy the new light (micro)-type trucks made in Hebei, and each household is limited to buy only one unit.

From March 1, 2009 to December 31, farmers who buy micro-type trucks of 1.3 liters and below can enjoy the subsidies. Each household is limited to buy only one unit.

From February 1, 2009 to January 31, 2013, farmers who buy motorcycle can enjoy the subsidies. Each household is limited to buy two units.

(II.) The identification of light trucks and minibuses mentioned in this program are based on the first figure of “vehicle type" on the People's Republic of China’s Certificate of Vehicle attached to the vehicles. The vehicles will be identified as light trucks when the first figure is “1”or”3” or “5” and “total mass” is more than 1800 kg and no more than 6000 kg. Vehicles will be identified as minibuses when the first figure is “6”, and in the term of "emission and power (m1/kw)" the emission no more than 1300ml.

Light trucks, mini-buses, as well as motorcycles in line with the previous conditions published in Vehicle Manufacturer and Product Announcement by the Industry and Information Technology Department can be in the range of subsidies. Companies that produce and agree to promise and sign the compulsory certification on the quality of products, distribution outlets, after-sales service, price, sales statistics and policy advocacy work can be involved in the producing and sale of motorcars and motorcycle that will go to the countryside.

Redemption of light trucks should conduct the rejection as required by the relevant state regulations of scrapped three-wheeled or low-speed vehicles. Owners should provide the necessary elements and hand end-of-life vehicles to the established-by-law recycling businesses to dismantle, to obtain proofs of end-of-life vehicle recycling and deregistration certificates of motor vehicles issued by public security organs in charge of traffic control.

(III.) Proportions and Amounts of Subsidies

To abandon the three-wheeled vehicles (referring to the original three-wheeled agricultural vehicles, the same below) or low-speed vehicles (referring to the original four-wheel agricultural vehicles, the same below), and buy light trucks, farmers can get the subsidies of 10% of the trucks’ sales price. If the truck’s price is more than 50,000 yuan, there will be a fixed subsidy of 5000 yuan per unit. At the same time, there will be a fixed subsidy of 2000 yuan per unit for the scrapped three-wheeled vehicle and 3000 yuan for the scrapped low-speed vehicle.

On the purchase of the minibuses (including products from Hebei Changan Automobile Co., Ltd.), farmers will be subsidized by 10% of the sales price. If the minibus is more than 50,000 yuan, there will be a fixed subsidy of 5,000 yuan per unit.

On the purchase of light (micro)-type trucks made in Hebei (except for the ones that have already enjoyed the policy of subsidies), if the unit price is below 50,000 yuan, there will be a fixes subsidy of 1500 yuan for each one, and if the unit price is more than 50,000 yuan, there will be a subsidy of 2,000 yuan subsidy for each one.

On the purchase of motorcycles, farmers will be subsidized by 13% of the sales price. If the unit price is more than 5,000 yuan, there will be a fixed subsidy of 650 yuan for each unit.

( IV.) Source of Subsidies

Subsidies are financed by central and provincial finances, of which the central finance occupies 80% and the provincial finance 20%.

( V.) Declaration for Subsidies

Farmers who abandon the three-wheeled vehicles or low-speed vehicles and buy light trucks should declare subsidies in financial departments of local villages and towns in which their residence is registered, and they must provide the following materials:

Proofs of end-of-life vehicle recycling and deregistration certificates of motor vehicles;

Sales invoices of newly purchased motor vehicles, a driving license or motor vehicle registration certificate issued by public security organs in charge of traffic control, and  a photocopy of People's Republic of China’s Certificate of Vehicle stamped with the profession seal of local administration departments officially in charge of vehicles;

ID card of the buyer, household registration book or household registration certificate proved by the public security departments;

Savings Passbook of the Purchaser (exclusive passbook of food subsidies can also be used).

Farmers who buy the new light (micro-) type trucks should declare subsidies in financial departments of local villages and towns in which their residence is registered, and they must provide the following materials:

Sales invoices of newly purchased motor vehicles, a driving license or motor vehicle registration certificate issued by public security organs in charge of traffic control, and  a photocopy of People's Republic of China’s Certificate of Vehicle stamped with the profession seal of local administration departments officially in charge of vehicles;

ID card of the buyer, household registration book or household registration certificate proved by the public security departments;

Savings Passbook of the Purchaser (exclusive passbook of food subsidies can also be used).

Farmers who buy the minibus or the motorcycle should declare subsidies in financial departments of local villages and towns in which their residence is registered, and they must provide the following materials:

Sales invoices of newly purchased motor vehicles, a driving license or motor vehicle registration certificate issued by public security organs in charge of traffic control, and  a photocopy of People's Republic of China’s Certificate of Vehicle stamped with the profession seal of local administration departments officially in charge of vehicles;

ID card of the buyer, household registration book or household registration certificate proved by the public security departments;

Savings Passbook of the Purchaser (exclusive passbook of food subsidies can also be used).

(VI.) Review and Allocation of Subsidies

There is "review at the township level and payment at township level" or "review at the township level and payment at county level." Financial departments of counties and towns should inspect the certificates and other materials, as well as the goods’ accordance with the relevant regulations of this program.

If the approach of "review at the township level and payment at township level" is adopted, financial departments of villages and towns should inspect the relevant materials in the first place.  If the purchaser is in line with the subsidy requirement, departments should appropriate the subsidy directly to the purchaser’s passbook of savings accounts within 15 working days; if the purchaser fails to meet the requirements, he or she should be immediately informed. If the approach of “review at the township level and payment at county level" is adopted, financial departments of villages and towns should inspect the relevant materials in the first place. If the purchaser is in line with the subsidy requirement, departments should send them to the provincial departments of finance; if the purchaser fails to meet the requirements, he or she should be immediately informed. Provincial departments of finance should appropriate the subsidy directly to the purchaser’s passbook of savings accounts within the 15 days that the purchaser has applied.

The subsidy funds of this program should be "set aside in advance and given the liquidation afterwards." According to estimated scale of subsidy funds of the municipalities, counties (cities), the provincial financial department will allocate subsidies that the central budget and provincial finance share together within 15 working days. In accordance with the budget not less than 50% of subsidy funds in time, and the remaining subsidies will be allocated according to the demanded progress. Subsidies will be audited by the information system of the program, and allocated in accordance with the relevant provisions of the state treasury.

Before the end of March each year, the financial sectors of cities and counties (cities) will verify and summarize the last year’s use of funds in the region, and send to provincial office of finance to be audited.

(VII.) Supervision and management

Departments of Development and Reform must strengthen supervision of prices of motor vehicles and motorcycles, and get involved in the joint supervision and inspection. Industry and Information Technology Department should do strict management about the products and businesses that will go to the countryside. Public Security Department in Charge of Traffic Control should provide convenient and swift service for transacting plates and certificates for subsidized motor vehicles, and register them according to the strict requirements. Departments of Commerce should enhance the supervision and management of enterprises that are responsible for the recycling and dismantling of the end-of-life vehicles, prevent behaviors like trying to get a false certificate of reporting an end-of-life vehicle, and try to regulate and better the construction of the website. Administration Department for Industry and Commerce should strengthen the supervision and management of the market of motor vehicles and motorcycles based on relevant laws to protect the consumers’ right. Bureaus of Quality and Technical Supervision intensify supervision and checks about the products that will go to the countryside, strengthen product certification management, strictly enforce the "three guarantees", and recall defective products.

Sales prices of subsidize products shall not be higher than the market prices of similar products in the same period. Subsidized vehicles shall not be transferred within two years. Local departments of finance, development and reform committees, industry and information technology departments, public security, administration departments for industry and commerce, bureaus of quality and technical supervision should be coordinated to enhance the supervision and inspection of subsidy funds, end-of-life vehicles, purchase, transfer of ownership, market order, price, product quality management, etc. to prevent fraud from subsidies and effectively protect the legitimate rights and interests of farmers. No units or individuals may retain, misuse, and misappropriate the subsidy funds for any reason, or delay the time of payment.

Those who violate any rules of the relevant provisions above, once verified will be dealt with according to “Financial Illegal activity Punishment Punishment Rule " (State Council Decree No. 427) and so forth; suspects of committing a crime will be handed over to judicial organs.

III. Requirements of Organizing the Implementing of Work

The implementation of Motorcars and Motorcycles Subsidy Program for Rural Areas     is an important decision to promote the domestic consumption and cope with the international financial crisis, an important measure to promote the healthy development of the automobile industry, and also an important project of Huinong and strengthen the agriculture. Great importance should be attached to it. All regions should strengthen leading and organizing, enhance collaboration of all the sectors, and establish responsibility mechanism with different responsibilities on different people, carrying out effectively even the small and detailed work, and coordinating of all departments. Every region must make specific plans to carry out various tasks in an orderly manner according to the actual operations, fulfill the regional subsidies, and urge relevant sectors to allocate the subsidies to farmers in time. Supervision and inspection system should be established to make sure every problem that emerges will be solved immediately and all work will be enhanced in time. Propaganda strength should be improved to make sure the program is wildly-known among farmers. Basic level research should be often carried out to find out the on-going performance, make summary and give better suggestions about the policy, therefore, this good conduct can be fully done well.

Measures of Fiscal Subsidies on Hebei's Motorcars and Motorcycles Subsidy

Chapter 1: General Provisions

Article 1: The implementation of Motorcars and Motorcycles Subsidy Program for Rural Areas is an important project of Huinong and strengthen the agriculture In order to strengthen and standardize the subsidies to rural areas in our province, this law is made according to  Cars Capital Management, according to Circular of the Hebei's Motorcars and Motorcycles Subsidy Program for Rural Areas and the Measures of Fiscal Subsidies on Hebei's Motorcars and Motorcycles Subsidy Program by Hebei Province Department of Finance, Development and Reform Committee of Hebei Province, Industry and Information Technology Department of Hebei Province, Hebei Provincial Public Security, Hebei Provincial Administration for Industry and Commerce, and Hebei Provincial Bureau of Quality and Technical Supervision. (Finance & Construction ¡²2009¡³ No. 104).

Article 2: The term of fiscal subsidies on motorcars and motorcycles (hereinafter referred to as subsidies), refers to the funds arranged by the central and provincial finance and given to farmers by a certain percentage to purchase automobiles and motorcycles.

Article 3: Subsidies are paid in accordance with regulations of State Treasury Centralism Payment System and managed in the only acchount of the State Treasury, using the centralized payment.

Article 4: The management and use of the subsidies should be open and transparent, directional, scientifically managed and strongly supervised.

Chapter 2: Measures, Standards and Sources of Subsidies

Article 5: Measures

Farmers who buy subsidized vehicles and apply in the specified time, audited in line with the relevant conditions, are given direct financial subsidies.

Article 6: Proportion and Amount

To abandon the three-wheeled vehicles (referring to the original three-wheeled agricultural vehicles, the same below) or low-speed vehicles (referring to the original four-wheel agricultural vehicles, the same below), and buy light trucks, farmers can get the subsidies of 10% of the trucks’ sales price. If the truck’s price is more than 50,000 yuan, there will be a fixed subsidy of 5000 yuan per unit. At the same time, there will be a fixed subsidy of 2000 yuan per unit for the scrapped three-wheeled vehicle and 3000 yuan for the scrapped low-speed vehicle.

Chapter 3: Target, Product and Effective Time

Article 8: Target and Amount of Subsidies

From March 1, 2009 to December 31, farmers who report the three-wheeled vehicles (referring to the original three-wheeled agricultural vehicles, the same below) or low-speed vehicles (referring to the original four-wheel agricultural vehicles, the same below) as worthless and buy light trucks (hereinafter referred to exchange light trucks), will enjoy double subsidies of buying new ones and abandoning the old ones. From March 1, 2009 to December 31, consumers who have rural registered permanent residence and buy micro-type trucks of 1.3 liters and below can enjoy the subsidies. Each household is limited to buy two units.

Article 9: Subsidized Products

Light trucks. Based on the People's Republic of China’s Certificate of Vehicle attached to the vehicles, its "vehicle type" of the first figure should be "1" or "3" or "5", and "total mass (kg)" should be more than 1800kg but not more than 6000kg.

Minibuses. Based on the People's Republic of China’s Certificate of Vehicle attached to the vehicles, its "vehicle type" of the first figure should be "6", and in the term of "emission and power (m1/kw)" the emission no more than 1300ml.

Motorcycles

Article 10: Effective Time: Time for subsidized motor vehicles is from March 1, 2009 to December 31, 2009, time for subsidized motorcycles to the countryside is from February 1, 2009 to January 31, 2013.

Chapter 4: Payments and the Liquidation of Subsidies

Article 11: Provincial Ministry of Finance should put subsidies into effect in time after received them from the central finance, issue specification document within 15 working days, and allocate 50% of the subsidies to the county-level finance according to the budget document. The remaining funds should be paid according to demand and above-mentioned procedures. If the actual subsidies are in excess of the budget, they should be paid by the finance of counties beforehand.

Article 12: Financial departments of counties and other relevant sectors verify and aggregate last year’s subsidies in mid-March every year, and report them to local regions and cities for preliminary examination. Financial departments of local regions and cities should send the preliminary examination to the Provincial Ministry of Finance for auditing and liquidation before April 20 every year.

Article 13: Financial departments of cities and counties should make detailed rules for implementation based on specific situations, and report to Provincial Ministry of Finance to be recorded.

Chapter 5: Declaration and Pay of the Subsidies

Article 14: Declaration of Subsidies

(I.) Purchasers hold relevant materials and declare subsidies in financial departments of villages and towns in which their residence is registered.

(II.) Famers who buy light trucks declare subsidies in financial departments of villages and towns in which their residence is registered should provide following materials:

Proofs of end-of-life vehicle recycling and deregistration certificates of motor vehicles;

Sales invoices of newly purchased motor vehicles, a driving license or motor vehicle registration certificate issued by public security organs in charge of traffic control, and  a photocopy of People's Republic of China’s Certificate of Vehicle stamped with the profession seal of local administration departments officially in charge of vehicles;

ID card of the buyer, household registration book or household registration certificate proved by the public security departments;

Savings passbook of the purchaser (exclusive passbook of food subsidies can also be used).

Farmers who buy light (micro-) type trucks made in Hebei declare subsidies in financial departments of villages and towns in which their residence is registered should provide following materials:

Sales invoices of newly purchased motor vehicles, a driving license or motor vehicle registration certificate issued by public security organs in charge of traffic control, and  a photocopy of People's Republic of China’s Certificate of Vehicle stamped with the profession seal of local administration departments officially in charge of vehicles;

ID card of the buyer, household registration book or household registration certificate proved by the public security departments;

Savings passbook of the purchaser (exclusive passbook of food subsidies can also be used).

Farmers who buy minibuses and motorcycles declare subsidies in financial departments of villages and towns in which their residence is registered should provide following materials:

Sales invoices of newly purchased motor vehicles, a driving license or motor vehicle registration certificate issued by public security organs in charge of traffic control, and  a photocopy of People's Republic of China’s Certificate of Vehicle stamped with the profession seal of local administration departments officially in charge of vehicles (those who purchased motorcycles are not included);

ID card of the buyer, household registration book or household registration certificate proved by the public security departments;

Savings passbook of the purchaser (exclusive passbook of food subsidies can also be used).

Article 15: Auditing and Payment of Subsidies

(I.) Financial departments of villages and towns should examine the materials of application based on this law, which include:

Integrality and authenticity of the materials;

Whether the content of the declaration is in line with the rules of Chapter 3;

Whether the declared account belongs to the owner;

Other things needed to be checked.

(II.) Financial departments of villages and towns should give the qualified a note of “Audited” on the sales invoice after verifying, ask the applicant to sign on the Application of   Motorcars and Motorcycles Subsidy Program for Rural Areas, and attach copies of relevant materials to the application for reexamination. Report the qualified ones in time through “information system of Motorcars and Motorcycles Subsidy Program for Rural Areas” and inform the disqualified ones immediately by giving detailed explanation.

(III.) There is "review at the township level and payment at township level" or "review at the township level and payment at county level." If the approach of "review at the township level and payment at township level" is adopted, financial departments of villages and towns should inspect the relevant materials in the first place.  If the purchaser is in line with the subsidy requirement, departments should appropriate the subsidy directly to the purchaser’s passbook of savings accounts within 15 working days. If the approach of “review at the township level and payment at county level" is adopted, financial departments of villages and towns should log on “information system of Motorcars and Motorcycles Subsidy Program for Rural Areas” and inspect the reported materials in time. If the purchaser is in line with the subsidy requirement, the subsidies should be allocated directly to the purchaser’s passbook of savings accounts within 15 working days since the purchaser has applied. If the purchaser fails to meet the requirements, there should be a note on the system.

(IV.) Refund of subsidies. If the purchaser asks for a refund as a result of bad quality of the product, he or she should go to financial departments of villages and towns for auditing after get approval from the sales business and the note of “return permitted”. If subsidies have not been given to the purchaser, staff from financial departments of villages and towns should sign “subsidies not given and return permitted” and stamp on the sales slip after successfully apply for return on the “information system of Motorcars and Motorcycles Subsidy Program for Rural Areas”. Sales businesses will deal with the return on seeing this slip.

Chapter 6: Supervision and Inspection

Article 16: Provincial departments of finance take main and direct responsibility in auditing of subsidies, management of payment, supervision and inspection, and investigate and deal with conducts that violate relevant rules and regulations. Provincial Ministry of Finance and financial bureaus of regions and cities should take dynamic inspection on payments of subsidies. Within the 15 days after the end of each quarter, finance bureaus of all regions, cities and counties of direct provincial supervision   should report the situations of subsidy use and purchase to the provincial departments of finance and the latter will inspect by random sample aperiodically.

Article 17: Financial departments of cities and counties should organize meticulously, deploy carefully and arrange scientifically to make sure the subsidies are given to the purchasers timely and fully.

Article 18: During the payment, no units or individuals may retain, misuse, and misappropriate the subsidy funds for any reason, charge farmers for anything, or delay the time of payment. Any fraud of subsidies will be strictly forbidden. If any of the previously mentioned acts are spotted by financial departments at different levels during the inspection, subsidies will be stopped and asked bask. Those who violate any rules of the relevant provisions above, once verified will be dealt with according to “Financial Illegal activity Punishment Punishment Rule " (State Council Decree No. 427) and so forth; suspects of committing a crime will be handed over to judicial organs.

Chapter 7: Supplementary Articles

Article 19: This law will be implemented from March 1, 2009.

Article 20: The Provincial Ministry of Finance shall be responsible for the interpretation of these Regulations.
